Michael Jordan Tells Court He Felt No Fear of the Racing Body in Antitrust Trial

The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his drive to win and novelty within the sport emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Financial Stakes and a Will to Win

The owner disclosed financial and corporate details of his 23XI team, revealing he invested $40m of his own funds into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I believed I could take on Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

At issue is the expiration of a 2016 deal where Nascar provided each team a franchise. The concept is similar to other major leagues with independent franchises, like the Charlotte Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan testified for an hour and left the court to pandemonium, with fans and media clamoring for a view or a photo of the sports legend.

Spearheading the Fight

Jordan’s 23XI is at the forefront of the push along with another racing team for Nascar to change a business model Jordan said is breaking the law to maintain excessive control.

At issue for Jordan and Heather Gibbs, who testified before Jordan, are events from last September. Gibbs described a hectic and tense period where the racing circuit told teams they must sign a contract extension. The document spanned over a hundred pages detailing team compensation and a guaranteed spot in every race.

Choosing Litigation

Jordan said that his team and its ally concluded their sole viable path was to decline to sign that extensive document and litigate the matter. The other 13 organizations signed the agreement.

Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar wasn’t talking, according to his testimony.

The Ultimate Motivation: Winning

Ultimately, the resistance against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Success.

“Denny convinced me adding a third car improved our chances to win,” he said, sharing that he bought a third charter last year for $28m amid the legal dispute. “So I took the plunge.”

Account from the Gibbs Family

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She said the timing of the signature deadline was problematic.

According to her, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, I have 20. If there are 30, I have 30.”
